Clarification regarding the adoption of a temporary Decision on the names of streets and squares in Rožaje

The Law on Territorial Organization was adopted in 2011 (Official Gazette of Montenegro 54/11, 26/12, 27/13, 03/16, 31/17, 86/18 and 03/20) and in accordance with the law there was it is necessary to make a Decision on the name of the settlement, streets and squares.

As the municipality has not adopted a Decision on the name of settlements, streets and squares since 2011, that is with amendments, the Parliament of Montenegro adopted the Law on Amendments and Amendments to the Law on Territorial Organization of Montenegro on December 27, 2019 (Official Gazette of Montenegro no. 03/20), which stipulates the obligation of the President of the Municipality, that if the assembly of the local self-government unit has not determined the names of all streets and squares by the date of entry into force of this law, to make a decision on the temporary determination of the names of streets and squares within 30 days from entry into force of the law.

In accordance with the above, the president formed a Commission that drafted the Proposal of Decision, in accordance with the law. Pursuant to the Decision, the name of the settlement, street and square can only be determined by the president of the municipality
numerical terms and geographical terms from the specific unit of local self-government. The decision will cease to be valid upon entry into force of the decision of the assembly of the local self-government unit on determining the names of settlements, streets and squares (Article 10a of the Law on Territorial Organization of Montenegro).
In connection with the cited legal regulation, the Decision on the temporary determination of the names of streets and squares in the territory of the municipality of Rožaje was adopted.

Therefore, it is a temporary decision that ceases to be valid on the day of the adoption of a new decision by the Rožaje Municipal Assembly. The name of the street could only be determined by numerical terms or a geographical term characteristic of that area.

In the following period, the Municipal Assembly, with the previously obtained opinion of the local communities on whose territory the settlement, street or square is located, and which can be determined by geographical and other terms, significant events or prominent personalities, in accordance with Article 10 of the Law on Territorial organization of Montenegro, to make a decision on the names of streets and squares in the territory of the municipality of Rožaje. If the name of a settlement, square or street is determined by a significant event or prominent person, the law governing memorials is applied.

Changes to the names of streets, settlements and squares are decided by the assembly of the local self-government unit, and proposals or initiatives to change the names of settlements or streets can be initiated by the municipal assembly or 30% citizens who have the right to vote in the settlement or settlements for which the change is requested.
For the aforementioned reasons, we inform you that a temporary decision was made on the name of streets and squares, which was a legal obligation, and according to which streets could be named only by numerical and geographical terms characteristic of that area.

Please note, the Decision on determining the names of streets and squares in the city area from 2000 still remains in legal force. On the basis of the same listed street, they kept their old names. In the scanned version of the document, you can see which streets are in question.
